摘 要:我国法官助理制度是在自上而下的强制性制度变迁中产生和发展起来的。但在制度实际运行过程中暴露出的与既有制度的冲突、与法官养成规律不合等突出问题,是法官助理制度必须解开的制度症结。未来的法官助理制度应尊重法官选任制度改革成果、调整四级法院功能定位、遵循法官养成规律。并且通过对法官助理重新进行分类,调整不同层级法院法官助理的招录方式,在基层人民法院探索建立“递补法官制度”,为法官助理成长为合格的法官搭建必要的桥梁等方式,推动实现法官助理制度的创新发展。The system of judge assistant in China is created and developed in a top-down compulsory institutional reform. However, in the process of implementation, its conflict with the existing system and incompatibility with the principle governing the growth of judges are the crux of the institutional problem that the judge assistant system must resolve. In the future, the judge assistant system should respect the results of the reform of the system of selecting and appointing the judges, adjust the functional positioning of the courts at the four different levels, and follow the priniciple governing the growth of judges. It should also promote the innovative development of the judge assistant system by reclassifying judge assistants, adjusting the methods of recruiting judge assistants at different levels of courts, exploring the establishment of a “replacement system” in basic-level people’s courts, and building the necessary bridges for judge assistants to grow into qualified judges.
