论正当防卫时间的认定问题

摘　　要：正当防卫是公民在公权力无法及时救济的情况下,依法享有维护自身合法权益的一种特殊权利。然而由于学界和司法实务中关于正当防卫时间的认定尚存诸多问题,导致出现错判等情况。因此本文率先通过学理和司法实践中关于其开始和结束时间的认定分析,提出需要结合不法侵害是否具有紧迫性和危害性的特征来进行判定,谨防因为防卫时间认定不准确出现的防卫不适时的情形。Justifiable defense is a special right for citizens to safeguard their legitimate rights and interests according to law when the public power cannot remedy it in time.However,there are still many problems in the identification of justifiable defense time in academic and judicial practice,resulting in wrong judgment and other situations.Therefore,this paper takes the lead in analyzing the identification and analysis of the beginning and end time in science and judicial practice,and puts forward the need to determine whether the illegal infringement has the characteristics of urgency and harm,to guard against the situation of improper defense due to the inaccurate identification of the defense time.
