我国反垄断罚款制度的结构优化研究

摘　　要：反垄断罚款制度是各国反垄断法规制垄断行为的核心制度,我国反垄断法的罚款制度在威慑垄断行为和罚款数额的计算中具有独特的规制效果。各个国家和地区对于垄断行为的罚款制度构造体系都具有准确的构造选择。但在我国反垄断制度适用过程中,罚款制度的结构性构造略有不足,究其根源在于我国反垄断法罚款制度的构造结构较为单一化。针对具体案件中,要素功能性分析不完善等问题仍需重点关注。目前,针对企业的反垄断合规调查与处罚案件数量不断增加,然而我国反垄断罚款制度中的规定尚存遗憾,采取直接计算罚款数额的制度结构体系并没有十分清晰地体现制度中的结构优势,因此有必要进行结构性改革与优化,以更好地发挥我国反垄断法的功能优势,促进我国形成更加良好的竞争秩序。Anti-monopoly fine system is the core system of the regulation of monopoly behavior in various countries'anti-monopoly law.The fine system of our country's anti-monopoly law has a unique regulation effect in the calculation of deterring monopoly behavior and fine amount.Each country and region has the accurate construction choice for the fine system of monopoly behavior.However,in the application process of our anti-monopoly system,the structural structure of the fine system is insufficient.Its origin lies in the structural structure of our anti-monopoly law fine system is relatively simple.In specific cases,the functional analysis of factors is not perfect and other problems still need to be paid attention to.At present,in view of the enterprise's antitrust compliance investigation and punishment cases number increasing,however,rules of antitrust fines system in our country there is regret,take the direct calculation of fines system structure system is not very clearly reflect the system structure of the advantages,so it is necessary for structural reform and optimization,in order to better play to advantages of China's anti-monopoly law,Promote China to form a better competition order.
