摘 要:关于船舶联名保险的性质,理论上存在单一财产险说、单一责任险说、单一保证保险说及混合保险说。英国司法实践倾向于将船舶联名保险认定为单一财产险,并将船舶联名保险合同视为合同束或可分割的合同,我国对此并不明确。结合域内外的相关规定和理论,明确船舶联名保险为单一财险并且合同具有可分割性,从风险转移及期待利益论证船舶联名保险的承保基础,引入“普遍保险利益”以协调船舶联名保险外部独立性和内部综合性存在的矛盾,以强制规范干预船舶联名保险投保主体的法律地位和保险理赔的第一受益对象,并从司法功效上探究船舶联名保险的法律效益,这些是船舶联名保险在实务层面运用的法律需求。Regarding the nature of joint-insurance of ships,there are different views in theories including property insurance,liability insurance,guarantee insurance and mixed insurance.The British judicial practice tends to recognize the joint-insurance of ships as property insurance,and consider the contract of joint-insurance of ships as a binding or separable contract,which is not explicitly provided in China.In view of relevant regulations and theories,it should be clarified that the joint-insurance of ships is property insurance and the contract is separable.The underwriting foundation of joint-insurance of ships should be demonstrated from the perspective of risk transfer and expected benefits,and the introduction of"universal insurable interest"is to coordinate the contradiction between the external independence and internal comprehensiveness,with a view to intervening in the legal status of the insured subject and the first beneficiary of insurance claims and exploring the legal benefits of joint-insurance of ships from the perspective of judicial effects,which is also the legal demand for the practical application of ships'joint-insurance in practice.
