摘　　要：为保障被海盗或武装劫持海员的基本权利,分析《〈2006年海事劳工公约〉2018年修正案》(以下简称《2018修正案》)生效的影响,采用“事实分析+理论归纳”以及比较分析的论证方法,总结被劫持海员在权利保障方面现存的主要问题,从海员被劫持后的就业协议效力、工资支付和遣返保障等3个方面分析《2018修正案》较之国内法的完善内容,阐述《2018修正案》在中国适用存在的利与弊。通过分析《2018修正案》转化适用的法律基础和具体方式及各方履约措施,研究中国因应。本文为制定保障被劫持海员权利的中国方案,积极履行国际公约要求的义务,妥善行使国际公约赋予的权利,提供有益参考。In order to protect the basic rights of seafarers hijacked by pirates or armed force,and to analyze the impact of Amendments of 2018 to the Maritime Labour Convention,2006(hereinafter referred to as Amendments of 2018)coming into effect,this article adopts“factual analysis and theoretical induction”and the argumentation method of comparative analysis to summarize the existing main problems in the protection of the rights of hijacked seafarers,to analyze the improvement of Amendments of 2018 compared with the domestic law from three aspects of the validity of the employment agreement,the payment of wages and the guarantee of repatriation,and to elaborate the pros and cons of the application of Amendments of 2018 in China.Through analysis on the legal basis and specific methods for the application of Amendments of 2018 as well as the implementation measures of all parties,China’s response is researched.It provides useful references for formulating a Chinese plan to protect the rights of hijacked seafarers,actively fulfilling the obligations required by the international conventions,and properly exercising the rights granted by the international conventions.
