新时代背景下档案利用权和公布权“二元分离”的问题、原因与对策

摘　　要：新时代背景下,我国档案利用权和公布权的“二元分离”问题有着新的变化和呈现。文章通过文献研究法和政策分析法,对20世纪80年代以来的相关文献和法律法规的内容进行分析,发现新时代背景下档案利用权和公布权的“二元分离”问题包括:“公布”概念界定歧义和疏漏,侵犯公民档案利用权和知情权,违背信息传播规律、阻碍知识社会进步,档案公布权权责不一、规定模糊;分析认为导致该问题的原因为:过度保守和管制、法律法规尚不健全、转移风险和补救措施不合理。今后应规范“公布”概念、形成社会共识,切实保障公民的利用权和知情权,遵循信息传播规律和社会进步需要,约束单向公布权利、细化操作依据。Under the background of the new era,the problem of the“separation”of the right to use archives and the right to publish archives in China is showing new changes and appearances.Through the literature research method and policy analysis method,this paper analyzes the content of relevant laws and regulations since the 1980s,and finds that the“separation”of the right to use archives and the right to publish archives in the context of the new era includes:ambiguity and omission in the definition of the concept of“publish”or“publication”,infringement of citizens’right to use archives and their right to know,violation of the regular pattern of information dissemination,obstruction of the progress of the knowledge society,the rights and responsibilities of the right to publish archives are not equal and clearly defined.The analysis shows that the causes of the problem include excessive conservative and regulatory actions,imperfect laws and regulations,and unreasonable risk transfer and remedial measures.In the future,it is necessary to standardize the concept of“publish”or“publication”and form social consensus,effectively protect citizens’right to use and know,follow the regular pattern of information dissemination and the needs of social progress,restrict the right of one-way publication,and refine the operational basis.
