野生动物刑法保护的多维解释与法理完善——基于人工繁育野生动物保护视角

摘　　要：2022年4月7日最高人民法院、最高人民检察院联合发布的《关于办理破坏野生动物资源刑事案件适用法律若干问题的解释》第13条,明确了人工繁育野生动物案件的处理规则。适用该规则,要厘清野生动物犯罪保护的法益,认识到野生动物与人类生存利益之间存在着密不可分的联系。文章对《解释》遗留的诸如条款解释不够明确,不能对新发现物种给予及时的保护,对未确立涉人工繁育野生动物案件中平台责任等问题提出了相应的解决方案;对涉及人工繁育野生动物案件定罪量刑应当确立综合评判标准;结合考量行为实质危害性,维护合法人工繁育动物交易市场的同时,维持生物多样性的平衡。Article 13 of the“Interpretation on Several Issues Concerning the Application of Law in Handling Criminal Cases of Destruction of Wildlife Resources”issued on April 7,2022,clarifies the handling rules for cases of artificial breeding of wild animals.Applying these rules,it is necessary to clarify the protection of wildlife crimes and realize that there is a close relationship between wildlife and human survival interests.The article puts forward corresponding solutions to the problems left over from the Interpretation,such as the unclear interpretation of the clauses,the inability to provide timely protection to newly discovered species,and the failure to establish platform responsibility in cases involving artificial breeding of wild animals.For the conviction and sentencing of cases involving artificially bred wild animals,comprehensive evaluation criteria should be established,taking into account the substantial harm of the behavior,and maintaining the balance of biodiversity while maintaining the legal artificially bred animal trading market.
