摘　　要：进入21世纪以来,随着全球数字经济快速发展,数字经贸规则体系逐步构建,目前已形成美式模板、欧式模板和亚太模板并存的发展格局。中国在规则制定领域仍面临严峻挑战,统筹推进国内数字经贸规则与国际数字经贸规则互鉴融合发展已刻不容缓。系统梳理全球数字经贸规则的形成与发展过程,全面分析中国数字经贸规则现状以及高水平开放过程中面对的挑战和问题,提出主动融入高标准数字经贸规则制定体系的决策方向。一是以多边、区域、双边FTA为契机,加速对接高标准数字经贸规则;二是建立高效、畅通的规则共享机制,释放数字经贸规则红利;三是弥合企业利益与规则分歧,贯通规则创新路径;四是强化国内外数字经贸规则互鉴共赢与开放合作,提升我国与发达世界各国数字经贸规则博弈的“软联通”水平。Since the beginning of the 21st century,with the rapiddevelopment of global digital trade,the rule system of digital economy and trade has been gradually constructed,the development pattern of which consists of American model,European model and Asian-Pacific model.China still faces serious challenges in terms of rule making.It is imperative for us to promote the integration and comprehensive development of domestic and international digital economic and trade rules.This paper makes a systematic study on the formation and development of global digital economic and trade rules,the current situation of China’s digital economic and trade rules,as well as the challenges and issues in China’s high-level opening-up,coming up with the suggestions of actively participating in the construction of high-standard digital economic and trade rule making system.First,we should align our existing rules with the high standard digital economic and trade rules on the basis of multilateral,regional,and bilateral FTAs;Second,we should establish an efficient sharing mechanism for the dividends of digital economic and trade rules;Third,we should bridge the gap between corporate interests and rules,and pave the way for rule innovation;Fourth,we should join hands together to facilitate the development of digital economic and trade rules at home and abroad,and enhance the institutional connectivity of digital economic and trade rules between China and developed countries.
