摘　　要：维护警察执法权威与执法过错问责,都具有维护公安机关执法权威的功能,但两者却存在着利益取向冲突、功能导向抵牾和权力惯性相异等衔接困境,从而导致在现行维护民警执法权威工作规定中出现以公安机关执法权威覆盖警察执法权威、执法过错问责条款比重过大、内设机构承担角色冲突职能等问题,在一定程度上偏离维护警察执法权威的本位功能。需要从整体观的视角改善规范设计,重点是固守维护警察执法权威的本位功能、调减立法中的越位条款和配置合理的法治资源支持制度。Since the authority of police’s law enforcement mainly stems from common people’s trust and their conscious obedience to the police,the compelling force is only a kind of subsidiary means if necessary.Both the defendense on authority of police’s law enforcement and the accountability on faults of law enforcement maintains the public security agencies’authority,but there are dilemmas such as interest conflicts,function divergence and power distinctions.These dilemmas cause problems such as to replace the police’s law enforcement authority with the public security agencys’law enforcement authority,to perform excessive accountability on the faults of law enforcement,and to arrange the internal institutions undertaking the conflicting functions.The problems signify the deviations from the standard function of defending the authority of police’s law enforcement.In an overall view,it is necessary to improve the rules focusing on the standard function of defending the police’s law enforcement authority as well as reducing offside clauses in legislation,and allocating the reasonable and supportive legal resources.
