摘 要:近年来,欧盟相继对我国与“一带一路”沿线国家的合作产业发起反补贴调查,在主体要件、区域专向性以及效果要件等方面形成了欧盟规制跨境生产补贴的单边规则。欧盟此举在货物贸易领域初步创设了跨境生产补贴规则,与此同时,国际规则文本中还出现了有关服务和投资的跨境补贴规则。当前跨境生产补贴规则的发展存在经济、法律和政治层面的多重动因,根本动因是跨境生产补贴所支持的出口国产业升级威胁了进口国的产业竞争力与供应链安全。为推动形成“国内国际双循环”的新发展格局,我国须对不断发展的跨境生产补贴规则做好国内和国际两个层面的因应措施。In recent years,the European Union(EU)launched countervailing duty investigations against the industries where China cooperates with Belt and Road countries.EU's countervailing measures are forming its unilateral transnational production subsidy rules in terms of granting authority,regional specificity and granted benefit.These measures have developed preliminary rules of transnational production in merchandise trade.In the meantime,the text of international rules has witnessed emerging rules of transnational subsidies in trade in services and in investment.The development of transnational production subsidies rules has multiple rationales in economic,legal and political dimensions.The underlying rationale is that the industrial updating of exporting country supported by transnational production subsidies has posed threat to the economic competitiveness and supply chain security of the importing country.With a view to constructing a new development paradigm of“domestic and international dual circulation”,China needs to develop its domestic and international responses towards the ever-changing rules of transnational production subsidy.
