摘　　要：土地承包经营权流转纠纷可从侧面反映出当下土地承包经营权流转中的制度缺陷与现实问题。通过汇总70份信阳市土地承包经营权流转纠纷案例,划分为确权纠纷、侵权纠纷、合同纠纷3种类型,进一步分析主体、原告诉请、证据、程序、结案情况以及个案情况,提出立法者弥补法律规范缺失、司法者准确适用既有规则,政府正确定位行政职责对策建议,逐步形成规范化流转市场,健全多元化纠纷解决机制。The disputes over the circulation of land contractual management rights can reflect the institutional defects and practical problems in the current circulation of land contractual management rights from the side.70 cases of disputes over the transfer of land contractual management rights in Xinyang City were summarized and divided into three types:right confirmation disputes,tort disputes and contract disputes.The subject,original application,evidence,procedure,case closure and case situation were further analyzed,and the suggestions were put forward including legislators making up for the lack of legal norms,judiciary accurately applying existing rules,and government correctly positioning its administrative responsibilities to gradually form a standardized circulation market and improve the diversified dispute resolution mechanism.
