摘 要:“善意”的认定应以不动产登记簿的权利事项错误为前提,采取不知情且无重大过失说的基本规则。在具体认定规则上,基于我国国情,应当要求受让人尽到查阅登记簿、实地查看不动产占有状况、了解转让人的婚姻状况、实际支付全部或部分合理价格等注意义务。在“善意”的认定时点上,通过对不动产登记行为的性质界定、单方撤回登记申请的对抗力分析,认为受让人在提出登记申请时为善意即可。The identification of“bona fide”in the acquisition of real should be based on the premise of wrong record of rights in the register of real estate,and follow the basic principle of not being in the know and not having gross negligence.The specific identification should take China’s national conditions into account,should inform assignees of the obligations to be noticed,such as fully consulting the register,inspecting the real estate possession status on the spot,understanding the transferor’s marital status,and actually paying all or part of the reasonable price.As for the identification of“bona fide”,this paper analyzes of the nature of the registration behaviors and the resistance to unilateral withdrawal of the registration application,and points out that the assignee is“bona fide”when submitting the registration application.
