摘　　要：在特别法人定位下,我国农村集体经济组织财产权制度有必要进行重构。集体所有是我国公有制经济的组成部分,同时农村集体经济组织兼具营利性和社会保障等职能,其财产权制度重构不能简单照搬其他类型法人财产权制度。我国农村集体经济组织财产权制度重构应当以坚持社会主义公有制经济制度为基础,以特别法人定位为前提,以农村集体经济组织财产股权化为主线。我国农村集体经济组织财产权制度重构的内容主要包括:股权配置制度、经营决策制度、财产流转制度、行政监管制度、损害救济制度和有限破产制度等。Under special legal person positioning,it is necessary to reconstruct the property rights system system of rural collective economic organizations in China.Collective ownership is an integral part of China's public ownership economy.At the same time,rural collective economic organizations have for-profit and social security functions,etc.property rights system reconstruction cannot simply copy the property rights system of other types of legal persons.Reconstruction of property rights system of rural collective economic organizations in China should be based on the socialist public ownership economic system,with premise of positioning of special legal person,and the property equity of rural collective economic organizations as the main line.The reconstruction of property rights system of rural collective economic organizations in China mainly includes:equity allocation system,operation decision-making system,property transfer system,administrative supervision system,damage relief system and limited bankruptcy system,etc.
