摘　　要：我国目前法律上没有明文规定实用艺术品的定义及其保护方案。根据世界知识产权组织对实用艺术品的定义并结合各项知识产权的特点,现阶段我国实用艺术品既可以采取著作权保护也可以采取外观设计专利保护并不禁止双重保护。陶瓷实用艺术品作为实用艺术品的一种,将陶瓷本身的特殊性和外观设计专利与著作权的属性相结合,立足景德镇,针对不同类型的权利主体及相关特性构建相适应的知识产权保护体系,发生实际纠纷时,权利人的权利才能得到切实保障。Presently,there is no legal provision for the definition and intellectual property protection of practical art in China.However,according to the definition of practical art prescribed by the World Intellectual Property Organization and the characteristics of various intellectual property rights,China can adopt the copyright protection or the design patent protection,or both the two protection measures for practical artworks.Ceramic practical works of art,as a kind of practical artworks,they integrate in themselves the features of ceramics,patent nature of their appearance designs,and properties of copyright.Therefore,in Jingdezhen,known as"Porcelain Capital",a suitable intellectual property protection system should be built according to different subjects of right and the corresponding characteristics so that the rights of right holders can be effectively protected when disputes occur.
