摘　　要：《中华人民共和国反有组织犯罪法》是我国近年来扫黑除恶的综合性、专门性、阶段性的成果。它从我国国情和法治社会建设需要出发,与国际反有组织犯罪工作相接壤,在原则上体现了法益保护与人权保障的动态平衡:打击犯罪的手段推陈出新、互相协同;打击犯罪的目标注重对未成年人的保护;打击犯罪的政策秉持宽严相济的司法精神。但本法仍存在如下问题:第一,过于注重各机关之间的配合与协作而忽视了互相制约关系;第二,具体条款过于粗糙;第三,人权保障性条款尚不完善。为了实现本法与刑事法治程序相契合,有必要加强各机关之间的互相制约关系以防止打击极端化,细化具体程序并增加保障性、救济性条款以实现权利保障。The“Anti-Organized Crime Law of the People’s Republic of China”is a comprehensive,specialized and staged achievement of combating crime and evil in China in recent years.It proceeds from China’s national conditions and the needs of building a society ruled by law,connects with the international anti-organized crime work,and embodies the dynamic balance between the protection of legal interests and the protection of human rights in principle;the means of combating crime are innovative and coordinated;the goal of combating crime is to emphasize on protecting minors;the policy of combating crime upholds the judicial spirit of combining leniency with strictness.However,there are still the following problems in the law:first,it pays too much attention to the cooperation between various agencies and ignores the mutual restriction relationship;secondly,the specific provisions are too rough;thirdly,the human rights protection provisions are not yet perfect.In order to realize the compatibility between the law and the criminal legal procedures,it is necessary to strengthen the mutual restriction relationship between various agencies to prevent the crackdown extremely,refine the specific procedures and add safeguard and relief clauses to realize the protection of rights.
