摘　　要：近年来,上海市性侵害未成年人犯罪的案件数量和被害人人数都呈上升趋势。有关部门从制度层面、司法层面、社会层面采取了防范措施,但是,实践中面临许多困境。据此,适当借鉴域外做法,应当从被害预防、犯罪预防和制度供给三个方面改革完善性侵害未成年人犯罪的防范体系,主要包括:防范性侵害教育进家庭、学校、企业、社区,防范未成年人被性侵害风险;对性侵害未成人犯罪从严惩处,通过对罪犯信息的登记和公示、电子监管、从业限制等,避免再犯。同时,加大制度供给,织密性侵害未成年人犯罪的法网,加强被害后救助补偿,延长追诉时效期限,切实加强性侵害未成年被害人保护。In recent years,the number of minor crime cases and sexual abuse victims in Shanghai is rising trend,causing great concern.Relevant departments have taken preventive measures from the system level,judicial level and social level,however,they face many difficulties in practice.According to the causes of the formation of these difficulties,we need take measures from three aspects such as the murdered prevention,crime prevention and system supply to reform perfect minor crime prevention system of sexual abuse,they mainly include:sexual abuse prevention education in families,schools,businesses and communities,so as to be sexually assaulted risk guard against minors.The crime of sexual assault of minors is severely punished,through the registration and publicity of criminal information,electronic supervision,employment restrictions,and so on,to avoid recidivism.At the same time,increase the system supply,weave a tight legal net against sexual juvenile delinquency,strengthen afterwards relief compensation,ex-tend the limitation period,and strengthen the protection of sexual assault underage victim.
