摘　　要：随着改革开放和民营经济发展,民营经济概念法律化是从广义概念入法到狭义概念入法的演化过程。回溯民营经济概念的界定与流变有助于理解民营经济概念的学理生成与概念内涵的细致分类,学理概念在一定程度为法律界定起到理论支撑。通过考察民营经济概念进入中央文件与法律法规的历史分析,结合现行法律法规中广义的民营经济“活概念”,直观呈现民营经济概念在中国特色社会主义法律体系中的立法样态与立法表达。改革开放以来民营经济的法律概念嬗变与立法表达折射三个法政脉络:一是国家政策与法律法规的共演关系;二是宪法规范意蕴下的概念涵摄;三是法律体系内部张力下的概念生成。未来立法逐步统一民营经济法律概念是契合建设全国统一大市场的内在要求,并在法律规范层面为共同富裕的建设提供制度助力。With the reform and opening-up and the development of the private economy, the legalization of the concept of private economy is an evolutionary process from a broad concept into law to a narrow concept into law. Looking back at the definition and evolution of the concept of private economy is helpful to understand the theoretical formation of the concept of private economy and the detailed classification of its connotation. The theoretical concept provides theoretical support for the definition of law to a certain extent. By examining the historical analysis of the concept of private economy entering the central documents and laws and regulations,combined with the broad “living concept” of private economy in current laws and regulations, the legislative state and legislative expression of the concept of private economy in the socialist legal system with Chinese characteristics is intuitively presented. The evolution of legal concepts and legislative expressions of the private economy since the reform and opening-up reflect three legal and political contexts: the co-evolving relationship between national policies, laws and regulations. In the future, legislation to gradually unify the legal concept of the private economy is to meet the inherent requirements of building a unified national market, and to provide institutional assistance for the construction of common prosperity at the level of legal norms.
