为菲尼斯的自然法理论辩护——与刘清平教授商榷

摘　　要：菲尼斯伦理自然法理论构建的整体意图是基于当代哲学语境为自然法命题辩护,他立足于三个立场——事实与价值的分离、价值的多元主义以及自然法与上帝的分离——来实现这一意图。针对这一构建,刘清平教授作出了三点批判。他认为,菲尼斯没有贯彻事实与价值的二分法,并且混淆了基本善和道德要求,最终将信仰引入了理论构建中。在对菲尼斯批判的过程中,刘清平教授不仅误解和混淆了菲尼斯文本中的诸多概念,同时也未能把握其理论构建的整体意图,其所认为的菲尼斯文本中相互矛盾的表述实则是融贯的。The integral intention of John Finnis’s natural law theory is to defend the natural law thesis based on a contemporary philosophical view.He fulfills this intention on three standpoints:the separation between fact and value,the pluralism of values,and the separation between natural law and God.Professor Liu Qingping raises three objections against this theory.In his view,Finnis doesn’t insist thoroughly on the separation between fact and value;moreover,he mixes up the basic goods and moral requirements;finally,he allowes God to justify his theory.However,Professor Liu not only misunderstands and mixes up several concepts in Finnis’s texts,but also fails to grasp his integral intention.More importantly,Professor Liu believes that there are several contradictory statements in Finnis’s text,while they can be asserted coherently.
