裁判文书“司法索引”功能定位的形态演化与改革展望

摘　　要：在人民法院司法工作“车之两轮、鸟之双翼”的建设背景下,裁判文书显示出“司法索引”的功能定位,其改革孕育了裁判文书司法索引的萌芽形态。人民法院信息化建设的数字化、网络化和智能化进阶,实质上引发了人民法院裁判数据改革,裁判文书实现了从“被索引”到“索引化”的转变,司法索引功能定位形成;“要素索引”形态的出现,标志着裁判文书司法索引形态成熟。以知识为中心的人民法院信息化4.0版建设开启了裁判知识改革,裁判文书司法索引迎来从“要素索引”到“知识索引”的形态突破。为实现裁判文书司法索引形态的突破,需要进一步深化裁判文书改革,深推人民法院裁判数据改革,深耕人民法院裁判知识改革。Against the background of the construction of the“two wheels of a car and two wings of a bird”in the judi⁃cial work of people's courts,judgment documents demonstrate the functional positioning of a“judicial index”.The reform of judgment documents has given birth to the embryonic form of a judicial index.The digital,networked and intelligent ad⁃vancement of the information construction of people's courts has essentially triggered the reform of the judicial data of people's courts,and judgment documents have transformed from“being indexed”to“indexing”,leading to the functional positio⁃ning of a judicial index.The form of the“element index”marks the maturity of the judicial index.The construction of the knowledge-centered informatization version 4.0 for people's courts has kickstarted the reform of judicial knowledge,and the judicial index has ushered in a morphological breakthrough from an“element index”to a“knowledge index”.In order to a⁃chieve the breakthrough,it is necessary to deepen the reform of judgment documents,the reform of judicial data,and the reform of judicial knowledge.
