区域协同立法的实践路径与规范建构

摘　　要：第二次立法法修改增设了区域协同立法制度,这是对我国立法工作实践经验的总结与国家区域协调发展战略的贯彻,有助于发挥立法在国家治理体系和治理能力现代化中的积极作用。当下我国已形成了多样化的区域协同立法实践,但从国家法的层面,依法享有协同立法权的主体仅限于省、自治区、直辖市和设区的市、自治州的人民代表大会及其常委会。对于区域协同立法主体的数量要求及可否跨级协同立法等,我国未做明确规定,同时,对区域协同立法权的行使、区域协同立法协调机制、区域协同立法程序等也未做规定。区域协同立法制度的完善,应当重点从区域协同立法主体、立法权、立法协调机制及立法程序四个方面展开,适当扩大区域协同立法主体的范围,对跨级的区域协同立法行为不可一概否认,对区域协同立法主体的数量做必要的限制;对区域协同立法权的行使做必要的规制;充分发挥上级人大及其常委会、人民政府在区域协同立法中的协调作用;进一步拓展沟通交流渠道并从立法规划和计划、起草、提案审议、公布、批准、实施、监督等方面完善区域协同立法程序。The The Second amendment of the Legislative Law has added the regional cooperative legislation system for the first time,which is a summary of the practical experience of China's legislative work and the implementation of the national regional coordinated development strategy.It is helpful to play the positive role of legislation in the modernization of the national governance system and governance capacity.At present,China has formed a variety of regional cooperative legislative practices,but from the perspective of national law,the entities enjoying collaborative legislative power according to law are limited to the people's congresses and their standing committees of provinces,autonomous regions,municipalities directly under the Central Government and cities/autonomous prefectures divided into districts.There are no clear regulations on the number of entities of regional collaborative legislation and whether it can carry out cross-level collaborative legislation.At the same time,there are no regulations on the exercise,coordination mechanism and procedures of regional collaborative legislation.The improvement of the regional cooperative legislation system should focus on the following aspects:(1)the entities of regional cooperative legislation,legislative power,legislative coordination mechanism and legislative procedure,appropriately expanding the scope of the entities of regional cooperative legislation,not denying all of the cross-level regional cooperative legislation,and making necessary restrictions on the number of regional cooperative legislative entities;(2)enacting necessary regulations on the exercise of regional cooperative legislative power;(3)giving full play to the coordinating role of the people's congresses at higher levels,their standing committees and people's governments in regional collaborative legislation,and(4)further expanding communication channels and improving regional collaborative legislation procedures from the aspects of legislative planning,drafting,proposal deliberation,public
