摘　　要：日常家事代理权范围影响共同债务认定和举证责任,目前尚无明确标准。历史考察日常家事代理权制度,可以发现其内容与夫妻财产制紧密相关、不断变化,其本质是对婚姻共同体的彰显。改革开放以来,我国婚姻共同体程度降低,夫妻财产关系趋向多元化。以绝对分别财产制为基点求得的日常家事范围是所有夫妻财产制的最大公约数。由于绝对分别财产制的婚姻共同体程度最低,因此日常家事范围应界定为“数额不大”。但其并非微乎其微,而应结合夫妻年收入和年支出认定。由夫妻双方对此举证,怠于举证的做不利推定。多个债务的,该“数额不大”指举债总额;医疗费用应根据消费主体区别认定;消费贷款一律不属于日常家事。The scope of the right of marital representation,which is not clearly delimitated currently,affects the affirmation of joint debt and the burden of proof.By examining the right of marital representation historically,it is found that its contents are closely related to and constantly changing with the marital property system,and its essence is to highlight the marriage as a community.In China,the degree of marriage community has been decreasing,with the marital property system being diversified,since the reform and open-up policy was implemented.The scope based on the absolute separate property system is the greatest common divisor of all marital property systems.Because the absolute separate property system has the lowest degree of marriage community,the scope should be delimitated as a“small amount”.But it is not negligible as the scope is identified with the annual income and annual expenditure of both husband and wife,who should give evidence and would be subject to unfavorable presumption in case that he or she fails to provide proof.The“small amount”refers to the total amount of debts accrued in cases of multiple debts.Medical expenses should be identified according to different consumer subjects.Consumer loans are not included in the scope of marital representation.
