数字经济背景下包容审慎监管原则的制度化建构

摘　　要：包容审慎监管原则的实施能够打破传统市场监管理念在数字经济时代面临的困局,能够推动数字经济的发展,是数字经济时代市场监管必须坚持的指导原则。但是,作为法律原则,包容审慎监管原则不可避免地存在高度抽象性和不确定性的问题,进而产生监管时间不确定、监管力度不确定等具体实施困境。为此,对包容审慎监管原则进行制度化建设,可从以下几个方面入手:审慎而及时介入数字经济领域进行监管;根据不同的数字经济类型配置不同的监管力度;强化企业合规建设,增强协同监管效能;创新监管方式;完善容错机制,扩大创新空间。只有加强推动包容审慎监管原则的制度化建设,才能最终实现数字经济在发展中规范,在规范中发展。The principle of inclusive prudential regulation can overcome the dilemma faced by traditional market supervision concepts in the digital economy era,and can promote the rule of law and good governance in the digital economy,which is the guiding principle that market supervision must adhere to in the digital economy era.However,as a legal principle,the principle of inclusive prudential regulation inevitably has a high degree of abstraction and uncertainty,which in turn leads to problems such as uncertain regulatory time,uncertain regulatory intensity and backward supervision methods.To this end,it is necessary to institutionalize the principles of inclusive prudential regulation,including“prudent and timely intervention in the field of digital economy”,“different regulatory efforts according to different types of digital economy”,“strengthening corporate compliance construction to enhance the efficiency of collaborative supervision”,“innovative supervision methods”,and“improving fault-tolerant mechanisms to expand innovation space”to promote the principle of inclusive prudential supervision to be more explicit and rational,and ultimately realize the standardization of the digital economy in development and the development in standardization.
