摘　　要：海南自由贸易港法规制定权是一种地方立法权、授权立法权,其具有制定主体和立法范围上的限定性、立法内容上的变通性和创制性,其价值在于开放与发展。海南自由贸易港法规制定权的运行必须以习近平法治思想、“4·13”重要讲话、习近平总书记视察海南重要讲话精神为根本遵循,以《关于支持海南全面深化改革开放的指导意见》和《海南自由贸易港建设总体方案》为基本遵循。要处理好海南自由贸易港法规制定权的行使与维护国家法制统一的关系,处理好创制与变通的关系。在海南自由贸易港法规制定权的行使过程中,应当建立健全党委领导、人大主导、政府依托、公众参与、专家论证、会议表决的立法体制机制;统筹海南自由贸易港封关运作过渡期的立法权行使;与海南自由贸易港法规的备案机关和批准机关建立充分有效的沟通机制。As a kind of local legislative and delegated legislative power, the power of formulating Hainan Free Trade Port Regulations has the limitations in its subject and scope of legislation, and the flexibility and creativity of its content of legislation, and its value lies in opening up and development. While essentially adhering to Xi Jinping Thought on the Rule of Law, Key Remarks on April 13, and spirit of General Secretary Xi Jinping’s important speeches in the inspection of Hainan, the exercise of this power should generally follow the Guidelines on Supporting Hainan in Furthering All-Round Reform and Opening Up as well as The Overall Plan for the Construction of Hainan Free Trade Port. It is also supposed to handle the relationship between the exercise of this power and the maintenance of the unity of the national legal system, as well as the relationship between creation and adaptation. In the process of exercising this power of formulating Hainan Free Trade Port Regulations, it is suggested to establish and improve the legislative system and mechanism, which are led by the Party Committee, guided by the People’s Congress, and supported by the government with the public participation, the expert evaluation and the conference voting. Meantime, it is also a must to coordinate the exercise of legislative power during the transition period before the independent customs operation throughout Hainan Free Trade Port. Furthermore, a full and effective communication mechanism should be established with the filing and approval authorities of Hainan Free Trade Port regulations.
