论海南自贸港外籍人员就业制度的完善路径

摘　　要：在《海南自由贸易港建设总体方案》的规划设计中,海南自由贸易港作为中国对外开放的新高地,要形成“聚天下英才而用之”的人才集聚效应,对外籍人员在海南自由贸易港的就业、居留要形成宽松便利、开放包容的整体环境和制度支持。而要构建这种外籍人员就业制度,至少要从三个维度加以完善,即就业准入、居留保障和约束措施,推动外籍人员在海南自由贸易港“进得来、留得下、管得住”。海南应在国家移民管理局推动的外籍人员就业和居留制度改革的基础上,结合海南自由贸易港的发展实践,构建一套完整的、具有自贸港特色的外籍人员就业制度。In the design of The Overall Plan for the Construction of Hainan Free Trade Port, Hainan Free Trade Port, as a new highland of China’s opening up to the world, should "select the best minds across the land" to form the talent aggregation effects. And it is suggested to create the relaxing, convenient, open, and inclusive environment and system for the employment and residency of foreign talents in Hainan Free Trade Port. Establishing this kind of employment system for the foreigners involves the improvement of employment permission, residency guarantee and restrictive measures at least, so as to promote their "entry, stay, and supervision" in Hainan Free Trade Port. Along with the practice in the development of Hainan Free Trade Port, Hainan should build a complete employment system with the free trade port characteristics for foreign talents on the basis of the reform of employment and residency system for foreigners that are promoted by the National Immigration Administration of the People’s Republic of China.
