摘　　要：算法备案是我国在新时代创设的一项算法治理制度。这项制度是“有效市场与有为政府相结合”的治理原则在数字领域的延伸和创新,是在数字法治的实践背景下推进算法治理的一项重要举措。作为一项创新制度,需要以国家治理和数字法治的原理为指引,透视其法律属性、政策属性与治理功能,厘清算法备案对象所具有的技术与规范双重性质。在此基础上,以目的思维、合作思维、辩证思维、系统思维等科学方法推进算法备案制度建设,以良法善治的理念和机制,来规范、优化算法备案制度功能,进而最大限度地发挥其提高监管效能、控制算法风险、激励企业合规、保障公民权利、促进公共利益的作用,在法治的轨道上推进数字科技向善。The record-filing is an algorithm governance system created by China in the new era.It is an extension and innovation of the governance principle of"combing efficient market with active government"in the digital area,and an important initiative to promote algorithm governance under the practice of digital rule of law.As an innovation,it needs to follow the principles of state governance and digital rule of law.The legal and policy attributes and its role in governance should be investigated,while the dual nature of technology and regulation of the entities subject to algorithm record-filing should be clarified.On this basis,its system construction should adopt scientific methods such as purposeful thinking,cooperative thinking,dialectical thinking,and systematic thinking,apply the principles and mechanisms for good law and sound governance to regulate and optimize algorithm record-filing system so as to maximize its role in improving its regulatory effectiveness,controlling algorithm risks,encouraging corporate compliance,protecting citizens'rights and promoting public interests to promote the sound governance of digital technology along the track of law.
