摘 要:行政复议制度是推进法治政府建设的重要抓手,正面临新一轮立法修订。行政复议决定存在“决定前”和“决定后”的时点界分,因而引发复议第三人认定在“决定前”的程序性判断与在“决定后”的实体性结果之间的关系界定问题。相关司法判例已经从最初个案中未予正面陈述的模糊立场,发展到两种看似冲突的认定标准并存的状态。有必要区分冲突性案例在规范选择、论证侧重和解释方法的结构性差异,同时甄别在程序观、功能取向和效能主义的价值选择,进而回归司法审查强度来考察司法审查与行政复议之间的权力结构和边界,为融贯解释复议第三人认定中时点关系和行政复议法第三人条款修改提供依托法教义学和体系化论证的规范基础。Administrative reconsideration is an important leverage for promoting law-based governance,and it will face another around of legislative amendment.In making the administrative reconsideration decision,there is a difference of timing before the decision and after the decision,which brings about the issue of determining the relation between the procedural judgment before the decision and substantive results after the decision.In judicial practice,this issue was not responded,but now there are two sets of seemingly conflicting criteria for determining the timing.It is necessary to distinguish the structural differences of choice of norms,argumentation focus and interpretation methods among these conflicting cases,and to discern the choice of value for procedures,functional orientation and efficacy.Furthermore,it is necessary to investigate the power structure and boundary between the judicial review and administrative reconsideration by resorting to the strength of judicial review to provide legal dogmatics basis and systemic argumentation for coordinating the timing of identifying the third party in administrative reconsideration and the revision of the third party provision in Administrative Reconsideration Law.
