摘　　要：中国婚姻家庭立法(1949至今)历时七十多年,实现了体系优化、制度创新与价值遵循。婚姻家庭立法的体系优化表现为立法体系的完善与协同。婚姻家庭立法的制度创新源于理念创新、规范创新、适用创新。婚姻家庭立法的价值遵循在于秉持本土情怀、推进移风易俗、维护和谐稳定、回应社会关切。回望婚姻家庭立法的中国进路,可以感受立法模式与立法体系的时代特色。梳理婚姻家庭立法的制度创新与价值遵循,可以感受完善婚姻家庭制度、保障婚姻家庭权益、维护婚姻家庭秩序、促进社会和谐稳定的中国智慧。The marriage and family legislation in China has gone through more than 70 s(1949-present),and it has realized the refinement of system,institutional innovation and years value orientation.The institutional innovation of marriage and family legislation derives from the innovation of ideas,norms and applications.The value orientation is exemplified in following the indigenous traditions,promoting transformation of old practices,safeguarding harmony and stability and responding to social concern.In retrospect of the progress of marriage and family legislation in China,it has demonstrated the characteristics of the time in its legislative models and system.A review of its institutional innovation and value orientation can present the Chinese wisdom in improving the system,protecting the rights and interests,safeguarding the order of marriage and family and promoting social harmony and stability.
