摘 要:我国演艺人员限制从业制度体现在法律草案、地方性法规、国务院部门规章、行业规范中。《广播电视法(征求意见稿)》规定广播电视部门有权限制违法艺人的节目播放;禁毒地方性法规对涉毒艺人限制从业的期限、范围等内容做了具体规定;国务院部门规章禁止违法失德艺人参与演出;行业规范要求协会成员在行业范围内联合抵制违规艺人。在此基础上,立法机关应修订《禁毒法》相关规定,在法律法规中明确限制从业的具体内容;国家相关主管部门应落实行业监管责任;有关行业协会应设立解禁标准、补充救济措施,以完善涉毒演艺人员限制从业制度。The system of restricting the employment of entertainers in China is reflected in draft laws, local regulations, departmental rules of the State Council and industry norms. The Radio and Television Law(draft for soliciting opinions) stipulates that radio and television departments have the right to restrict the broadcasting of programs by illegal artists. Local laws and regulations on drug control make specific provisions on the time limit and scope of restrictions on drug-related artists. Departmental regulations of the State Council prohibit illegal and unscrupulous artists from participating in performances. Industry norms require association members to boycott illegal artists in the industry. On this basis, the legislative organs can clearly restrict the specific content of the industry in the laws and regulations by amending the relevant contents of the Drug Control Law. The relevant competent departments of the state should implement the responsibility of industry supervision. Relevant trade associations should set standards for lifting the ban and supplementary relief measures to improve the system of restricting the employment of drugrelated entertainers.
