摘　　要：政府法律顾问出具法律意见是其首要职责和主要履职方式,能够为政府决策提供法律专业补充和理性智识支持。然而,作为衡量政府法律顾问制度运行状态的标尺,政府法律顾问法律意见的内涵和外延尚未明晰,法律定位和效力判断尚需探究,亟待合法性规制。故通过对政府法律顾问法律意见进行法学释义、属性解析和类型研判,可以明确其法律定位和效力面向。在此基础上,从确定基本原则、完善出具程序、提升内容质量、厘清责任机制等方面着手,逐步探索政府法律顾问法律意见合法性规制的有效路径。Issuing legal opinion is government counselors'primary responsibility and is also the main way of performing their duties,which can reinforce and support government's decisions professionally and rationally.However,as the criteria for assessing the operation of government counselor system,the connotation,extension,legal status and effect of government counselors'legal opinion are still needed to be developed,which make it necessary to regularize the opinion.The legal status and effect of government counselors'legal opinion could be clarified by the legal interpretation,attribute analysis and type analysis on it.Then,we can regularize government counselors'legal opinion effectively from different ways,such as determining the basic principles,completing the issuance procedure,improving the quality of content and clarifying the responsibility mechanism.
