摘 要:研究目的:释明和增设集体经营性建设用地使用权流转合同的效力性强制规定,明确法律后果,完善集体经营性建设用地使用权流转法律制度,为人民法院裁判纠纷提供确定性指引。研究方法:法律文本分析、法律规范解释和理论分析。研究结果:集体经营性建设用地兼具社会资源、集体所有、财产三重属性,释明和设置流转合同的效力性强制规定,必须符合公共利益、保障农民集体和成员利益、比例原则三项准则。研究结论:集体经营性建设用地使用权流转合同因违反特定规划、未采用公开竞价方式、低于政府规定的最低价而全部或部分无效。农民集体决议规则、地方政府同意规则、产业准入和环境保护的规定,并非集体经营性建设用地使用权流转合同的效力性强制规定。The purposes of this study are to improve the legal system of rural construction land transfer and to provide definitive guidance for people’s courts in adjudicating disputes by explaining and adding the mandatory provisions on the validity of rural construction land transfer contract to clear the legal consequences.The research methods include legal text analysis,legal norm interpretation and theoretical analysis.The results show that since rural construction land is featured by social resources,collective ownership and property rights,explaining and adding mandatory provisions on the validity of its transfer contract should be formulated based on the principles of public interest,interest protection of rural collectives and their members,and proportionality.In conclusion,rural construction land transfer contract shall be wholly or partially invalid in that it violates specific planning,leases the land without public bidding or sets a price lower than the minimum price stipulated by the government.Farmers’collective decision making,the approval of the local government,specific requirements of industrial access and provisions on environmental protection are not the mandatory provisions on validity of rural construction land transfer contract.
