人权保障视角下个人破产制度的价值证成与立法展望

摘　　要：从破产有罪论到友好型个人破产理念的历史转变,不仅体现了现代风险社会变革下的必然发展趋势,也意味着“人的价值”愈发得到重视。从平等价值、“失败者正义”理念以及社会保障救济三方面来看,“以人为本”是个人破产制度设计的核心,个人破产法的制定应当将“人的因素”放在首位,为“诚实而不幸”的债务人提供基本生存权和发展权的保障。人权保障价值的引入决定了个人破产在制度设计上必然区别于企业破产。在构建个人破产制度这项系统工程中,除了理论支持,还必须设置配套制度以切实平衡各方利益,因而债务免责等规则也必须加快完善,以期为不幸破产的人群提供制度保障。The historical change from the theory of bankruptcy guilt to the concept of friendly bankruptcy not only reflects the inevitable development trend under the modern risk society reform,but also means that“human value”is getting more and more attention.From the perspectives of equal value,the concept of“loser’s justice”and social security relief,“peopleorientation”is the core of the design of personal bankruptcy system.The formulation of personal bankruptcy law should put“human factors”in the first place to provide“honest and unfortunate”debtors with the basic right to survival and development.The value of human rights protection determines that personal bankruptcy is inevitably different from corporate bankruptcy in system design.In the systematic project of building a personal bankruptcy system,in addition to theoretical support,a supporting system must be set up to effectively balance the interests of all parties.Therefore,debt exemption and other rules must also be improved quickly in order to provide protection for the unfortunately bankrupt.
