摘　　要：体育产业已成为我国国民经济的支柱产业.其中,通过电视、网络等新兴媒体对体育赛事进行转播所产生的体育赛事转播产业是其重要组成部分.体育赛事转播权是体育赛事转播产业的核心权利.但目前在实践中,围绕体育赛事转播权所产生的争议较多,对体育赛事转播权的法律保护还不太完善,相关法律条款分散在著作权法、合同法、反不正当竞争法等多部法律中,存在保护力度不足、保护不够系统等问题.因此,为更好地促进我国体育产业的健康发展,应当加快相关立法,将体育赛事转播权纳入无形财产权予以保护,并将体育赛事广播权纳入广播组织权的规制范围,从而建立有力的法律保护机制.The sports industry has become the pillar industry of China's national economy.Among them,the sports event broadcasting industry,which is generated by the broadcasting of sports events through emerging media such as TV and the Internet,is an important part of it.The broadcasting right of sports events is the core right of the sports event broadcasting industry.However,in practice,there are many disputes surrounding it,and the legal protection is insufficient.Relevant legal provisions are scattered in copyright law,contract law,anti-unfair competition law and other laws.Therefore,in order to promote the healthy development of sports industry in China,relevant legislation should be accelerated.The broadcasting right of sports events should be included in the protection of intangible property rights,and in the regulation of broadcasting organization rights,thereby creating a strong legal protection mechanism.
