清代的司法成案研究

摘　　要：清代司法成案是由某些业已生效的典型案件判决汇集而成,其形成目的是为弥补制定法的僵化性与滞后性缺陷。成案制度的社会功能是维护统治者的统治地位、稳定社会秩序、进行伦理教化、遏制资本主义萌芽和巩固传统农业的核心地位,法律功能是诠释判决的合理性、增强判决的权威性以及在“律/例无正条”的情况下“以案定罪”。成案适用的一般方式是直接援引成案进行案件裁判,证成律例与现审案件之间的对应性,或者为刑罚裁量提供参照基准。远年成案不适用和情节歧异排除适用只是从消极方面肯定成案法源的效力,真正对成案法源效力构成否定性影响的仅有“未经通行”。Judicial cases in the Qing Dynasty were made up of some typical case judgments that had already taken effect,and the purpose of their formation was to make up for the rigidity and lag defects of statutes.The social function of the case--finishing system is to maintain the ruling position of the ruler,stabilize the social order,carry out ethical education,curb the germination of capitalism,and consolidate the core position of traditional agriculture;the legal function is to interpret the rationality of judgments,enhance the authority of judgments,and conviction by case in the case of no legality.The general method applicable to a completed case is to directly cite the completed case to judge the case,to prove the correspondence between the statute and the case currently being tried,or to provide a reference benchmark for penalty discretion.The non-applicability of cases completed in the past years and the exclusion of application due to differences in circumstances only affirm the effectiveness of the legal source of the completed case from a negative aspect,and the only thing that really negatively affects the effectiveness of the completed legal source is the unapproved.
