摘　　要：数字化疫情防控导致个人信息的采集出现井喷现象,公共卫生安全和个人信息保护之间紧张关系日渐凸显。协调二者之间的利益冲突,是数字化疫情防控措施得以长久良性运行的关键。为此,在公法制度方面,应在严格信息收集主体资格认定,推行承诺书和保证金、建立专门个人信息保护机关、检察机关提前介入等多个方面作出回应。私法层面,针对大规模个人信息侵权行为,引入惩罚性补偿金等制度,以达到震慑和预防的目的。Digital epidemic prevention and control has led to a blowout of personal information collection,and the tension between public health security and personal information protection has become increasingly prominent.Coordinating the conflict of interests between the two is the key to the long-term benign operation of digital epidemic prevention and control measures.For this reason,in the aspect of public law system,we should make responses in many aspects,such as strict qualification identification of information collection subjects,implementation of letters of commitment and deposits,establishment of special personal information protection organs,and early intervention of procuratorial organs.At the private law level,for large-scale personal information infringement,punitive compensation and other systems are introduced to achieve the purpose of deterrence and prevention.
