新修订《体育法》背景下我国体育赛事活动法律制度环境的现实审视与优化路径

摘　　要：研究以新修订《体育法》的出台为背景,综合运用文献资料法、逻辑分析法、文本分析法等研究方法,从体育赛事活动的立法、执法和纠纷解决三个角度对我国现行的体育赛事活动法律制度环境进行梳理。研究发现,体育赛事活动的法律制度环境存在体育立法建设供需不匹配、体育行政执法效能有限、体育纠纷解决机制不完善等法治问题。据此提出完善体育赛事活动政策法规体系、加强体育赛事活动行政执法工作、健全体育赛事活动纠纷解决机制等建议,以期持续优化我国体育赛事活动法律制度环境。The study takes the introduction of the newly revised Sports Law as the background,and integrates the research methods of literature,logical analysis and textual analysis to sort out the current legal institutional environment of sports events activities in China from three perspectives of legislation,law enforcement and dispute resolution of sports events activities.It is found that the legal system environment of sports events has real problems such as the mismatch between supply and demand of legislation,the limited effectiveness of sports administrative law enforcement,and that the dispute resolution mechanism of sports industry needs to be further improved.Accordingly,the study proposes to improve the policy and regulation system of sports event management at all levels,strengthen the administrative law enforcement of sports event activities and improve the multi-dimensional dispute resolution mechanism of sports event activities,in order to provide theoretical references for the continuous optimization of the legal institutional environment of sports event activities in China.
