中日数字贸易监管规制规则及其影响差异研究

摘　　要：中日两国都是推动数字贸易发展的重要经济体,但是两国的数字贸易在内容、规模、监管规制规则等方面存在差异。日本方面,由于公民个人信息保护意识较强、企业数据的本地化特征显著等因素阻碍了数字经济政策的实施以及数字经济的发展,其数字贸易监管规制表现出较宽松的特征,其开放水平也相对较高。中国的数字贸易规模发展迅速,增长强劲。但出于数据安全考虑,数字贸易监管规制相对较严,服务贸易总体的数字化交付能力也依然有待提升。今后,中国面临加快提高数字核心技术水平和加强数字技术核心领域产品开发的考验,同时需积极参与国际数字贸易规则谈判,并加快构建既适合中国数字经济与贸易发展又能够适应国际数字贸易规则的“中式模板”,以保障数字经济与贸易的健康可持续发展。China and Japan are economic giants stimulating the digital trade development,but differences exist between their individual digital trade contents,scales,rules and regulations.In terms of Japan,due to Japanese citizens'consciousness of individual privacy protection,obvious firm data localizations and other factors alike actually constraining the implementation of digital trade policies and digital trade development,Japanese digital trade is relatively open with relatively easing digital trade regulations.Chinese digital trade scale has rapidly and greatly developed with robust growth tendency,but out of the consideration of data safety,Chinese digital trade rules and regulations are relatively strict,and Chinese digital delivery of service trade is still to be developed further.In the future,China is faced with issues including the upgrade of its core digital technological level and product development,and in the meantime,China is supposed to actively participate in international digital trade rule negotiations,and accelerate the process of constructing"Chinese Model"of digital trade rules,which is applicable to not only Chinese digital economy and trade development but also international digital trade rules,so as to secure the sustainable development of digital economy and trade.
