摘  要:中国是全球缔结双边投资条约最活跃的国家之一。目前中国经历了三次双边投资条约的现代化转型。当下国际投资协定在对新自由主义的反思、全球化理论及环境、社会治理理论发展的趋势下,正经历较为剧烈的变动。国际投资条约的持续改革为中国提供了一个机会,可以从传统的规则接受者角色转变为重新设计BITs的规则制定者角色。因此,通过对三代中国BITs的分析,阐述了条约内容在不断更新过程中的背景、原因、特征及其内在缺陷,总结了中国BITs现代化转型的背后原因,在此基础上,分析了中国在“一带一路”倡议下BITs现代化改革中的路径选择,提出在投资者-国家争端解决、加强国家监管以及推进可持续投资理念等方面进一步完善的建议。China is one of the most active countries in the world in concluding bilateral investment treaties(BITs). Currently China has undergone three modernized transformations of BITs. Current international investment agreements are undergoing more dramatic changes in the light of the rethinking of neoliberalism, theories of globalization and the development of environmental and social governance theories. The ongoing reform of international investment treaties provides an opportunity for China to shift from its traditional role as a rule taker to a rule maker role in redesigning BITs. Therefore, by analyzing three generations of Chinese BITs, the backgrounds, causes, characteristics of the treaty content and its inherent shortcomings in the process of continuous updating are expounded, and the reasons behind the modernized transformation of Chinese BITs are summarized, based on which China’s path in the modernized reform of BITs under “the Belt and Road” initiative is analyzed, and further improvements are put forward in investor-state dispute resolution, strengthening state regulation, and promoting the concept of sustainable investment.
