我国钟表行业的反垄断问题研究

摘　　要：我国钟表行业以进口为主,进口钟表尤其是高端钟表是拉动国内高端消费的驱动力。高端钟表市场份额高度集中,产业链高度纵向一体化,这提高了市场进入壁垒,从而导致限制竞争。目前我国钟表行业的垄断行为主要发生在高端钟表市场,涉及销售市场和售后市场,垄断行为包括垄断协议、滥用市场支配地位和经营者集中等多种形式;垄断行为排除、限制了钟表行业的有效竞争,同时严重损害了经销商、独立钟表维修商和消费者的利益。鉴于此,我国反垄断执法机关应适时启动对钟表行业的反垄断执法,优先查处搭售行为,尽快制定相关反垄断指南;同时健全反垄断诉讼保障制度,鼓励钟表行业的反垄断私人诉讼,从而促进我国钟表行业的健康发展。At present,watches in China watch industry are mainly imported and the imported watches,especially high-end watches,are the driving force of domestic high-end consumption.The market share of high-end watches is very concentrated and the industrial chain is highly vertically integrated,which raises the market entry barrier and results in the restriction of competition.Judging from the current situation,the monopoly of China's watch industry mainly occurs in the high-end watch market.These monopolistic behaviors involve not only the sale market of watches,but also the after-sale market of watches,including monopoly agreement,abuse of dominant market position and concentration of operators.These monopolistic behaviors exclude and limit the effective competition in the watch industry and seriously damage the interests of dealers,independent watch repairers and consumers.In view of the current situation,we should initiate the antimonopoly law enforcement of the watch industry in time,investigate and prioritize the tying behavior,and formulate antitrust guidelines for the watch industry as soon as possible.At the same time,we should also improve the anti-monopoly litigation protection system and encourage the anti-monopoly private litigation of the watch industry,so as to promote the healthy development of China's watch industry.
