网络侵犯著作权犯罪的侦查难点与对策

摘　　要：近年来国家对于著作权保护以及侵犯著作权犯罪打击的意识不断增强,互联网空间为犯罪活动提供的便利条件也使得该类犯罪的应对措施逐步转移至对网络侵犯著作权犯罪的打击。因网络侵犯著作权犯罪的非复制性侵权、隐蔽性转播等特点,犯罪现场勘查、信息与证据获取的难度不断增加。对此应通过明确“主动战、整体战、协同战”战略,加强信息收集、提升侦查中技术整体化应用、增强侦查协作,形成对网络侵犯著作权犯罪打击的新机制。In recent years,the national awareness of copyright protection and the fight against copyright infringement crimes has been continuously enhanced.With the convenient conditions provided by the Internet space for criminal activities,the response to such crimes has gradually shifted to the fight against the crime of copyright infringement on the Internet.The difficulty of crime scene investigation,information and evidence acquisition is increasing due to the characteristics of non-copy infringement and hidden retransmission of copyright infringement crimes on the Internet.In this regard,the strategy of“active war,integrated war and coordinated war”should be defined to strengthen information collection,improve the integrated application of technology in investigation,enhance investigation cooperation,and to form a new mechanism to crack down on the crime of network copyright infringement.
