大湾区知识产权仲裁实践及其对成渝地区的启示

摘　　要：完善知识产权纠纷多元化解决机制,有助于推动成渝经济圈建设全国具有影响力的科技创新中心。知识产权仲裁具有尊重当事人自主性、效率性、经济性、专业性与保密性的优势,粤港澳大湾区在知识产权仲裁方面积累了较好的经验。中国香港立法确认知识产权纠纷的可仲裁性,将其在民商事争议仲裁中的特长延伸至知识产权领域;中国澳门精准定位“中国与葡语国家商贸争议仲裁中心”寻求差异竞争;广州仲裁委则储备大量专业化与国际化的仲裁人才,积极与社会各界合作推广仲裁解决纠纷,并着力构建互联网仲裁平台。成渝两地仲裁机构可取长补短、择善而从,具体包括深化各方合作,推广知识产权纠纷仲裁解决;优化规则设计,重视知识产权仲裁的保密性;探索在线仲裁,建立知识产权ODR平台;重视人才培养,加强国际化、专业化仲裁员队伍建设。Improving the diversified settlement mechanism of intellectual property disputes will help promote the construction of the Chengdu-Chongqing economic circle as a national influential science and technology innovation center.Intellectual property arbitration has advantages of respecting the autonomy,efficiency,economy,professionalism,and confidentiality of the parties.The Guangdong-Hong Kong-Macao Greater Bay Area has accumulated good experience in intellectual property arbitration.Hong Kong legislates to recognize its arbitration ability of intellectual property disputes,extending its expertise in civil and commercial arbitration to intellectual property.Macao seeks to differentiate itself by positioning itself as a center for arbitration of commercial disputes between China and Portuguese-speaking countries.The Guangzhou Arbitration Commission,with a large pool of specialized and international arbitration talents,actively cooperates with other institutions to promote arbitration in dispute resolution and strives to build an Internet arbitration platform.Arbitration institutions in Chengdu and Chongqing can learn from the Greater Bay Area.Those institutions should deepen cooperation among all parties to promote arbitration in IPR disputes,optimize the design of rules and emphasize the confidentiality of IPR arbitration,explore online arbitration and establish an ODR platform for IPR disputes;and emphasize the training of arbitration talents and strengthen the construction of international and professional arbitrators.
