摘　　要：1980年国家颁布《中华人民共和国律师暂行条例》,后又于1996年颁布《中华人民共和国律师法》(以下简称《律师法》)并先后于2001年、2007年、2012年和2017年对其进行四次修订,目前,我国即将启动对《律师法》的第五次修订。《律师法》的颁布及修订,确立了符合时代要求的律师性质定位、确立了律师的核心执业权利、确立了完备的“律师行为规范-责任”体系、确立了符合中国国情的“两结合”律师行业管理体制。建议即将修订的《律师法》重点修改以下五个问题:将“四个忠于”“两个拥护”确立为律师执业条件中的政治标准;确立律师执业宣誓制度;用“列举+兜底”的模式规定律师业务范围;吸纳《法律援助法》的立法成果;整合和完善值班律师制度规范。The State promulgated the Temporary Regulations on Lawyers in 1980,followed by the Lawyers Law in 1996,which was revised four times in 2001,2007,2012 and 2017.At present,China is about to start the fifth revision of the Lawyer Law.The promulgation and revision of the Lawyer Law has established a lawyer’s nature in line with the requirements of the times,established the core practice rights of lawyers,established a complete"lawyer’s code of conduct-responsibility"system,and established a"two combination"lawyer industry management system in line with China’s national conditions.It is suggested that the Lawyer Law to be revised should focus on the following five issues:"Four Loyalties"and"Two Crowds"should be established as the political standard in the lawyer’s practice conditions;Establishing the oath system of lawyer’s practice;To expand the scope of lawyer’s business,we can change the scope of lawyer’s business to the mode of"enumerating and covering";Absorb the legislative achievements of the Legal Aid Law;Integrate and improve the system of on duty lawyers.
