摘　　要：进入数字时代,数据成为推动经济发展的重要战略资源之一,其在世界范围内的流动性对其价值的实现有着显著影响。当前,世界范围内尚未形成统一的数据跨境传输规则,欧洲作为数据立法领军地区,以GDPR为基础构建起个人数据跨境传输规则,标准合同条款是传输规则中极为重要的一条路径。从SCCs到IDTA,此次个人数据跨境传输规则的调整将会给中国企业对欧洲数据跨境传输规范的理解、企业数据合规成本控制和企业风险防范能力提出挑战。破题之道在于三管齐下:企业需要适应该规则的调整,梳理企业内外业务关系,规范数据跨境传输行为;行业内需要构建企业间互助机制;国家需要加强对欧洲数据传输规则的理解,完善数据跨境传输制度构建。In the digital era,data has become one of the important strategic resources to promote economic development,and its worldwide mobility has a significant impact on the realization of its value.At present,no uniform rules for cross-border data transfer have been formed worldwide.Europe,as a leading region in data legislation,has built up rules for cross-border transfer of personal data based on GDPR,and standard contractual clauses are an extremely important path in the cross-border transfer rules.From SCCs to IDTA,the adjustment of personal data cross-border transfer rules will challenge Chinese enterprises'understanding of European data crossborder transfer norms,enterprise data compliance costs and enterprise risk prevention ability.The way to solve the problem lies in a three-pronged approach:enterprises need to adapt to the adjustment of the rule,sort out business relationships inside and outside the enterprise,and regulate the behavior of data cross-border transmission;the industry needs to build a mutual assistance mechanism between enterprises;the state needs to strengthen the understanding of the European data transmission rules and improve the construction of the data cross-border transmission system.
