摘　　要：阐述了国际工程中履约保证相关的国际规则依据,对涉及履约保证的国际商会ICC758号及ICC524号出版物相关概念进行了说明及差异比较,探讨了履约保函及履约担保在国际工程中的区别应用,并对其中的转让与让渡进行了概念与应用的辨析,最后就反担保的法律冲突进行了讨论并提出避免措施。This paper expounds the international rules basis for performance guarantee in international projects.It explains and compares the relevant concepts of ICC758 and ICC524 publications involving performance guarantees.It discusses the different applications of performance letters of guarantee and performance bonds in international projects.It analyzes the concepts and applications of transfer and assignment.Finally,it discusses the legal conflicts of counter-guarantees and proposes measures to avoid them.
