《黄河保护法》背景下水土保持与生态修复的制度调适——以流域中上游地区为规制重点

摘　　要：黄河流域是我国重要的生态功能地带,自中华人民共和国成立以来该地区的水土保持与生态修复实践已开展了七十余年。随着《黄河流域生态保护和高质量发展规划纲要》的提出,以及《中华人民共和国黄河保护法》等法律规范性文件的相继出台,黄河流域系统修复框架下的水土保持工作也被赋予了新的时代使命。为解决相关实践在大流域尺度、生态脆弱区域、小流域单元、林草管护领域存在的问题,未来应在水土保持工作选择性纳入生态修复大系统的基础上,通过“自然恢复为主”原则的确立、黄河流域统筹协调机制的落实、地方河湖长制的职能拓展、适应性管理方法的逐步推广,实现流域中上游地区水土保持与生态修复的制度优化。The Yellow River basin is an important ecological function zone in our country.The practice of soil and water conservation and ecological restoration in this area has been carried out for more than seventy years since the founding of the People’s Republic of China.With the introduction of the Outline of the Yellow River Basin's Ecological Protection and High quality Development Plan,the promulgation of the Yellow River Protection Law of the People's Republic of China and other legal normative documents.the work of soil and water conservation under the framework of the system restoration of the Yellow River basin has been regarded as a new mission of the times.In order to solve the problems existing in the largescale watershed,ecologically fragile areas,small watershed units,forest and grass management and protection,the work of soil and water conservation should be selectively incorporated into the large-scale system of ecological restoration in the future.The system optimization of soil and water conservation and ecological restoration in the middle and upper reaches of the Yellow River basin is realized through the establishment of the principle of“letting nature restore itself”,the implementation of the overall coordination mechanism of the Yellow River basin,the function expansion of the system of local river and lake chiefs,and the gradual promotion of the adaptive management method.
