网络造谣型寻衅滋事罪司法认定争议问题研究

摘　　要：寻衅滋事罪作为规制虚假信息的兜底罪名,是打击虚假有害信息的现实需要,对净化网络环境、维护网络公共秩序具有积极价值,不宜全盘否定甚至废弃。对真伪暂时不明的信息、举报揭发性质的信息,以及有一定事实根据且可能产生积极社会效果的高价值言论信息,有必要宽容以待,留出合理时间加以检验。在私密场合中虚构事实但本身没有传播故意,系被他人散布至网络的,属于单纯的编造行为,不应按照犯罪处理。为避免寻衅滋事罪口袋罪之污名化的加剧,刑事干预不宜过早,打晚但确保打实,要注重行刑衔接,恪守备而少用的谦抑原则,重点打击明显出于恶意且具有紧迫危险的虚假信息。对讽刺调侃性的过激言论不宜过度犯罪化,以避免引起损害言论自由与控制舆论的非议,反而削弱了打击真正网络谣言的正当合法性。As an overall crime to regulate fake information,the Crime of Picking Conflict and Provoking Troubles is practically necessary to curb the fake and hamnful information.With its positive value in purifying environment and maintaining public orders in the network The crime should not be denied or even abandoned.It is necessary to tolenate and allow reasonable time for testing information whose authenticity is temporarily unknown,information of a reporting and exposing nature,and high-value commenting message that has certain factual basis and may produce positive social effects.Fabrication in private occasions without the intention to spread,which is instead disclosed by other people on the Internet,is pure fabrication and should not be treated as a crime.In order to avoid the aggravation of the stigmatization of the Crime of Picking Conflict and Provoking Troubles,criminal intervention should not be carried out too early;instead,the punishment should hit the nail on the head no matter how late it maybe.The connection between administration and execution should be stressed,adhering to the modest principle of being cautious and using less,and focusing on combating malicious false information with urgent risks.Overcriminalization of sarcastic and ironie statements is inappropriate since it would cause criticism of impairing freedom of speech and controling publie scrutiny,and weaken the legitimacy of their efforts to combat genuine online rumors.
