摘　　要：互联网交易迅猛发展的大背景下,作为网络交易核心主体的网络店铺存在转让的现实需求,因网络店铺属性在司法、理论及实务处理层面并无一致态度,导致网络店铺的转让诉求出现了被差异化对待的现象。网络店铺转让符合民法基本理论,更符合现实需求,应充分考量网络店铺经营者、平台利益及消费者权益的基础上理顺店铺转让路径,而非简单地禁止转让或允许自由转让。Under the wave of rapid development of Internet transaction,online store,the core subject of online transactions,has an urgent need for transfer freedom.However,due to no clear consistent attitude towards online store at the judicial,theoretical and practical level,differentiated treatment happens when online store operators handle the transfer.Not only online store transfer conforms to Civil Law basic theories,but also in line with actual need demand,the interests of online store operators,online platform and consumers will be taken into consideration to clear the path of online store transfer,rather than simply prohibiting transfer or allowing freely transfer.
