权力清单:地方政府的制度实践与改革深化--基于H省的实证分析

摘　　要：权力清单制度的推广实施,对依法管理政府部门行政职权,加强对政府权力运行的制约与监督,合理限制政府机关工作人员权力行使的自由裁量空间,推进政府机构内部职能的优化整合具有重要的意义。权力清单制度实施以来,地方政府在行政权力的规范化制度化管理、积极作为、提升治理质效等方面取得了显著的成绩,同时在实践中暴露了职权管理工作中的一些薄弱环节,行政法治意识依然有待提高进一步深化政府权力清单制度改革,需要在中央层面加强统筹规划,制定普遍性的清单管理工作规范,并适时引入立法机关审查机制,完善必要的公众参与程序。The promotion and implementation of the power list system has a significant impact on the management of administrative power,and the mechanism of restraint and supervision over power operation.It will also reasonably limit the discretion of the civil servants and promote the functional transformation of local governments.Since its implementation,local governments have made remarkable achievements in managing administrative power normatively,taking active actions,improving their governance and some aspects.However,some weak links were found in the management.It is still of great importance to enhance local government’s awareness of the rule of law.To deepen the reform,the central government shall improve the overall plan and enact laws about the regulation of power lists.The review system by legislature and some necessary procedures for public participation are ought to be established duly.
