多边开发银行版ENAA合同介绍及与FIDIC对比分析

摘　　要：对ENAA合同条件以及多边开发银行基于ENAA的改编版合同进行简要介绍,并选取亚洲开发银行2021年12月发布的《设备设计-供应-安装采购合同》和2017版FIDIC黄皮书,着重针对通用合同条件就两者差异进行对比分析。Based on the background of the ENAA Contract Conditions published by the Engineering Advancement Association of Japan,this paper firstly gives a brief introduction of the ENAA form by the Multilateral Development Banks for plant design and construction.Then,the detailed comparison,emphasizing the differences,between the ADB Conditions of Contract for Procurement of Plant Design,Supply and Installation 2021,as a representative of MDBs adapted ENAA,and FIDIC Yellow Book 2017,is made.
