摘　　要：2022年《社会信用体系建设法(征求意见稿)》将社会信用体系分为政务诚信、商务诚信、社会诚信和司法公信四个主要类型,并强化公共信用信息系统和征信系统两类按照不同逻辑进行信用信息处理服务的制度建设。有必要从外部视角重新审视个人信用信息法律制度结构的形成,即从生产方式的角度解释特定个人信息如何被生产出来,为了实现系统中的声誉和信用功能而转化为更加关键的信用基础设施。这需要对公共信用信息与征信信息两种信息基于生产方式重新解释,将其理解成基于经验演进的两种不同的信用信息系统,其中一种服务于网络化流动的经济生产方式,而另一种服务于地域性的网格化生产方式。个人信用信息因各自的目标差异而需要不同程度的信息合规要求。The Social Credit System Construction Law of 2022(Draft for Comments)divides the social credit system into four main types:governmental integrity,business integrity,social integrity,and judicial credibility,and strengthens the system of credit information processing services according to different logics for both types of public credit information systems and credit collection systems.It is necessary to re-examine the formation of the legal system structure of personal credit information from an external perspective,i.e.,to explain how specific personal information is produced and transformed into a more critical credit infrastructure in order to achieve the reputation and credit functions in the system from the perspective of the production method.This requires a reinterpretation of the two types of information,public credit information and credit information,based on the mode of production,as two different credit information systems based on empirical evolution,one of which serves the networked and mobile economic mode of production,while the other serves the sectional and territorial grid-based mode of production.Personal credit information requires different levels of information compliance requirements depending on the differences in their respective objectives.
