论人民美好生活的法治保障路径

摘　　要：党的十九大和二十大报告均将实现“人民对美好生活的向往”作为奋斗目标,这也是习近平新时代中国特色社会主义思想的重要内容。“人民幸福生活是最大的人权”,我们需要从权利话语出发,通过法治方式与路径,保障人民的美好生活。在宏观理念方面,人民美好生活具有特定的人权意涵:“美好生活”体现人最基本的价值追求;“美好生活”符合人最全面的社会追求。在具体实施方面,人民美好生活保障可诉诸美好生活权:美好生活权具有专门的人权属性;美好生活权具有特定的生成逻辑;美好生活权具有特定的权利形态。我们需要在中国特色社会主义法治体系建设中,保障和实现人民的美好生活权:用法律规范体系定位美好生活权;用法治实施体系落实美好生活权;用法治监督体系推进美好生活权。The reports of the 19th and 20th Party Congresses declare that our goal is to realize the “people's aspiration for a better life”,which is also an important part of Xi Jinping's thought of socialism with Chinese characteristics in the new era.“The biggest human right for the people is to live happily.”We need to protect this right starting from the right discourse and taking the way of the rule of law.At the macro level,better life has its particular content of human rights:better life reflects the most essential value pursuit of people and is in line with people's most comprehensive social pursuit.At the practical level,better life guarantee can resort to the right of better life,which has its special human rights attribute,definite generative logic and a specific form of rights.We need to safeguard and realize the people's right to a better life in the construction of the socialist legal system with Chinese characteristics,defining it within our legal regulation system,realizing it through the rule of law implementation system and promoting it with the legal supervision system.
